Jeff’s practice focuses on representing businesses and individuals in complex civil litigation in federal and state courts, arbitration proceedings and investigations by federal and state agencies, such as the Securities and Exchange Commission, and various state Attorney General’s offices.  Jeff has extensive experience in an all aspects of litigation from pre-litigation dispute resolution through trial and appeals.

Jeff began his legal career in 1999 and spent his first two years as a law clerk to the Honorable Edward W. Nottingham, U.S. District Court for the District of Colorado.  Following his clerkship, Jeff joined the national law firm of Cooley LLP where he worked from 2001 to 2011 as a litigation associate and special counsel.  In 2011, Jeff co-founded Smith Byers.

Representative Experience:

  • Counsel to medical device manufacturer in several multi-million dollar lawsuits brought by former distributors for breach of contract and business torts.
  • Counsel to Colorado-based solar company in lawsuit brought by former employee for breach of contract, securities fraud and other business torts.
  • Counsel to several telemarketing companies and their owners in investigation and civil enforcement action filed by the Colorado Attorney General.
  • Counsel to New York-based lender in two receivership and foreclosure matters totaling over $700 million.  Also represented lender in lender liability lawsuit alleging breach of contract and fraud relating to development of high-rise residential project in Denver.
  • Defended former CFO of software company in SEC enforcement action alleging securities fraud.  Following trial, the court entered judgment in the client’s favor.
  • Represented former CFO of publicly traded Colorado-based restaurant chain in  SEC investigation and private securities litigations.  The SEC closed the matter without filing an enforcement action against the client.  Obtained dismissal of all private securities litigation.
  • Represented oil and gas company and its directors in securities fraud arbitration brought by investor.  Arbitrator entered award in clients’ favor and award clients their attorney fees.
  • Represented Utah-based company and its officers and owners in multi-million dollar lawsuit alleging breach of contract, fraud and breach of fiduciary duty.  After the court granted summary judgment on the majority of claims, the matter settled favorably to clients.
  • Represented attorney in federal court case alleging legal malpractice.  The jury returned a verdict in the client’s favor on all claims.
